These Terms of Service (“Terms”) are an agreement between you and CDX Studios LLC (“CDX Studios,” “we,” “us”) for the mobile game Dodgelings and its related services (the “Game”). By tapping ACCEPT in the Game, or by downloading or playing the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not play the Game.

1. Who can play

You must be at least 13 years old to play. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.

2. Your license to play

We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, for your own non-commercial entertainment. The Game, including its characters, art, music, course designs and code, belongs to CDX Studios or its licensors. You may not copy, sell, rent, modify, reverse engineer or create derivative works of the Game except where the law expressly allows it.

3. Your account and gamer name

The Game creates an account for you automatically. You are responsible for activity on your account. Your gamer name is public and must not be offensive, hateful, sexual, impersonate someone else, or infringe anyone’s rights. We may change or remove a gamer name that breaks these rules.

4. Play fair

When you play, you agree not to:

• cheat, use bots, hacks, modified clients or exploits, or interfere with other players’ games;
• attack, overload or try to gain unauthorized access to our services or other players’ accounts;
• harass, threaten or abuse other players;
• sell, trade or transfer accounts or in-game items outside the Game;
• use the Game in any way that breaks the law.

We may suspend or end access to online features for players who break these rules.

5. Virtual items and purchases

The Game includes sparks, crystals, heroes, skins, gear, trails, the Blast Pass and other virtual items. Virtual items have no real-world money value, cannot be exchanged for cash, and are licensed to you, not sold. Purchases are made through the Apple App Store or Google Play and are subject to their terms; refunds are handled by Apple or Google under their policies, except where the law requires otherwise. Everything for sale is cosmetic or a convenience and gives no advantage on the course. Prices and contents may change. Your progress and virtual items are stored on your device; we are not responsible for items lost when the app is removed, except purchases that the store lets you restore.

6. Online features

Online play, friends and leaderboards depend on the internet and on our own game servers and third-party services (including our hosting provider, Apple Game Center and Google Play Games). We may change, suspend or stop features at any time, and they may not always be available or error-free.

7. No ads

The Game contains no advertising. If this ever changes, we will update these Terms and the Privacy Policy first.

8. Updates and changes

We may update the Game and these Terms from time to time. If we make significant changes to these Terms, the Game will ask you to review and accept them again. Continuing to play after accepting means you agree to the updated Terms.

9. Ending

You can stop playing at any time and delete your account in Settings (see our account deletion page). We may suspend or end your access if you break these Terms or if we stop offering the Game.

10. Disclaimers

The Game is provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. We do not promise that the Game will be uninterrupted, secure or free of errors.

11. Limitation of liability

To the fullest extent the law allows, CDX Studios will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or virtual items, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to the amount you paid us for the Game in the 12 months before the claim, or US $50, whichever is greater. Some places do not allow these limits, so they may not apply to you.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise. Courts in Travis County, Texas will handle disputes, unless the law where you live gives you the right to bring a claim locally.

13. Apple-specific terms

If you downloaded the Game from the Apple App Store, these Terms are between you and CDX Studios, not Apple. Apple has no obligation to provide maintenance or support for the Game and is not responsible for any claims relating to the Game. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
